Overview
These Terms of Service govern use of the public Murph Marketing website, including its inquiry, audit-request, and call-booking features. They do not replace a signed proposal, statement of work, hosting agreement, or other client agreement. If we undertake a project together, that separate agreement controls its scope, price, schedule, payments, deliverables, ownership, revisions, support, cancellation, and remedies. Please contact us if you have a question before submitting information or engaging our services.
1. Website information and estimates
We aim to keep the information on this website accurate, but descriptions, examples, availability, starting prices, and estimated timelines may change or contain errors. A displayed starting price is not a fixed quote or a promise that a particular project can be completed for that amount. We confirm the scope and price of a project in a written proposal or agreement before work begins.
2. Inquiries, audits, and intro calls
Submitting a form, requesting a free website audit, or booking an introductory call does not obligate you to hire Murph Marketing or obligate us to accept a project. An audit or initial discussion is an assessment based on the information available at that time, not a guarantee of traffic, search ranking, leads, revenue, accessibility compliance, legal compliance, or a particular business outcome. Please do not submit confidential credentials or highly sensitive information through public forms. Any formal engagement begins under separate agreed terms.
3. Client projects and ongoing services
Web design, development, SEO, hosting, maintenance, and support can involve different deliverables, vendors, schedules, and ongoing charges. The written agreement for each client specifies what is included and how changes, approvals, third-party costs, renewals, and support are handled. Website statements do not expand a signed project scope or create an unconditional service-level guarantee. Any rights to project files, code, content, and finished work are determined by the applicable agreement and third-party licenses.
4. Cancellation and refunds
The applicable signed proposal or client agreement sets out payment milestones, deposits, project cancellation, work completed, and any refund terms. Terms for recurring hosting or support—including price, billing frequency, renewal, and how to cancel—are disclosed before enrollment and reflected in the applicable agreement. 5. Permitted use
You may use the website for lawful purposes, including learning about Murph Marketing and contacting us about a possible project. You may not attempt unauthorized access, interfere with the site or its security, send malicious code or spam, impersonate someone else, submit fraudulent information, or use automated access in a way intended to disrupt or improperly extract from the site. We may restrict abusive activity where reasonably necessary.
6. Content and intellectual property
Content on this site includes Murph Marketing branding and writing, examples of client projects, and materials supplied or owned by third parties. Client names, logos, photographs, testimonials, fonts, software, and other third-party materials remain subject to the rights of their respective owners and any applicable agreements or licenses.
Websites also use familiar structures, navigation patterns, interface elements, typography choices, and development techniques. Murph Marketing does not claim exclusive ownership of those general elements. That does not affect anyone’s rights in their original content or other protected work.
Except where permitted by law or an applicable license, visitors may not copy, sell, or present Murph Marketing’s original site content as their own without permission.
7. Information you submit
You are responsible for ensuring you have the right to submit the information, business materials, and website URLs you send us. You authorize us to review and use those materials to respond to your request and, if we enter an agreement, to perform the agreed work. This does not transfer ownership of your materials to Murph Marketing. Our handling of personal information is described in the Privacy Policy.
8. Outside links and providers
The website may link to third-party sites or use third-party tools. Their availability, content, terms, and privacy practices are controlled by those providers. Additional terms may apply when you choose to use one of their services. This section does not override any responsibility Murph Marketing expressly accepts in a signed client agreement.
9. Website availability and disclaimer
The public website may occasionally be interrupted by maintenance, technical issues, or service-provider outages. To the extent permitted by law, we provide the public website and its general information without guaranteeing uninterrupted access, complete accuracy, or freedom from errors. Nothing here disclaims an express obligation we accept in a signed client agreement or a right that cannot lawfully be waived.
10. Limitation relating to public website use
To the extent permitted by applicable law, Murph Marketing is not responsible for indirect or consequential losses arising solely from use of, inability to use, or reliance on the public website. This section concerns the public website. A signed client agreement governs responsibility for paid project and ongoing service work. Nothing in these Terms excludes liability where exclusion is prohibited by law.
11. Governing law and severability
These website-use terms are governed by Wisconsin law, except where applicable law requires otherwise. If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law.
12. Changes
We may update these website-use terms as the site or our practices change. The Last Updated date identifies the current version. A change to this page does not automatically amend an existing signed client agreement.
